UAF WhatsApp Business Official Account Terms and Conditions

These terms and conditions (“Terms and Conditions” and as defined below) govern your use of WhatsApp Messenger to communicate with United Asia Finance Limited (the “Company” and as defined below) and access relevant services via the United Asia Finance WhatsApp Business Official account (the “UAF WhatsApp Account” and as defined below). Your continuing communication with the Company and/or access of relevant services via the UAF WhatsApp Account constitutes your acceptance of these Terms and Conditions and the terms and conditions of the “Hyperlink Policy”, the “Important Declaration”, the “Terms and Conditions for Access of the Website and Use of the Mobile App”, the “Terms and Conditions for Authentication Procedures”, the “Privacy Policy” and the “Notice to Customers and other individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” of the Company (all of which can be accessed at the official website of the Company). If you do not agree to any of the above terms and conditions, you should refrain from communicating with the Company or accessing relevant services via the UAF WhatsApp Account. The Company reserves the right to amend, revise, vary, modify and/or supplement any of the above terms and conditions at any time without prior notice.

1. Definitions

1.1 Unless the context otherwise requires, the capitalised terms under these Terms and Conditions shall have the following meanings:
1.1.1 “Company” means United Asia Finance Limited and its successors and assigns;
1.1.2 “Hong Kong” means the Hong Kong Special Administrative Region of the People’s Republic of China;
1.1.3 “IP Rights” means rights to any trademarks, service marks, logos, trade names, corporate names, Internet domain names, patents, registered designs, copyrights, design rights, database rights, rights in designs, inventions, semiconductor topography rights , know-how, trade secrets, other intellectual property rights or any similar rights exercisable anywhere in the world, and all applications or rights to apply for the same (where such applications can be made), whether presently existing or created in the future, and whether registered or not, and all benefits, privileges, or rights to sue, recover damages and obtain relief for any past, current or future infringement, misappropriation or violation of any of the foregoing rights;
1.1.4 “Service Contents” means the information, materials and content of whatsoever nature, including without limitation text, data, images, photos, graphics, trademarks, service marks, marks, icons, logos, videos, voice notes and any other multi-media contents, which you may be able to access or view via using the UAF WhatsApp Services;
1.1.5 “Terms and Conditions” means these terms and conditions as may be amended, revised, varied, modified, supplemented or otherwise in effect from time to time;
1.1.6 “Third Party Materials” means software, text, data, uniform resource locator (URL), images, photos, graphics, videos, marks, icons, logos, voice notes, other multi-media contents, materials or information, provided, uploaded, transmitted, submitted or posted by or sourced from a third party, which is made available in the course of your use of the UAF WhatsApp Services, including without limitation any contents from external sources, advertisements and links to third-party websites;
1.1.7 “UAF WhatsApp Account” means the UAF WhatsApp Business Official account, being the business account maintained by the Company on WhatsApp through which the Company may communicate with you and/or provide you with services;
1.1.8 “UAF WhatsApp Services” means any communication with and/or services which may be provided by the Company from time to time via the UAF WhatsApp Account on WhatsApp Messenger, including without limitation the services set out under Clause 3.2 below;
1.1.9 “Virtual Assistant” means an automated chat service programme operated and maintained by the Company that is designed to interact with customers and/or provide information relating to any services offered by the Company;
1.1.10 “WhatsApp” or “WhatsApp Messenger” means WhatsApp Messenger, the instant messaging application; and
1.1.11 “Your Contents” means any text, data, images, photos, graphics, voice notes, other multi-media contents, information and/or materials you may upload, submit, post or transmit to the Company via the UAF WhatsApp Account.

2. Amendments and updates

2.1 The Company may amend, revise, vary, modify or supplement these Terms and Conditions from time to time at the Company’s sole discretion without liability to you.
2.2 The Company will publish the revised Terms and Conditions on the UAF WhatsApp Account and/or in any other manner as the Company considers appropriate. Unless otherwise specified, the revised Terms and Conditions will take effect when they are published. Your continued use of the UAF WhatsApp Services after the publication of the revised Terms and Conditions will constitute your acceptance of the revised Terms and Conditions and all amendments, revisions, variations, modifications and/or supplements made to the Terms and Conditions. You should stop using the UAF WhatsApp Services, if you do not agree to any such amendments, revisions, variations, modifications and/or supplements made to these Terms and Conditions.

3. WhatsApp Services

3.1 The UAF WhatsApp Services may be supported by the staff of the Company or the Virtual Assistant.
3.2 Subject to Clauses 3.3 and 3.4 below, the scope of the UAF WhatsApp Services include: –
3.2.1 responding to general inquiries relating to the products and/or services provided by the Company;
3.2.2 assisting in identity verification process incidental to your access to any products and/or services provided by the Company from time to time;
3.2.3 assisting in submission of relevant documents in relation to your application for any products and/or services provided by the Company from time to time;
3.2.4 providing confirmation as to the status of any products and/or services of the Company you are using at the time, including loan confirmation;
3.2.5 responding to inquiries as to disbursement of proceeds relating to any loan products and/or services of the Company you are using at the time;
3.2.6 sending offers relating to any products and/or services provided by the Company from time to time;
3.2.7 sending promotional campaigns relating to any products and/or services offered by the Company from time to time;
3.2.8 requesting for a call back if the Company has lost contact with you; and
3.2.9 any other services which may be provided by the Company from time to time via the UAF WhatsApp Account as it considers appropriate.
3.3 The Company has the right to determine or specify from time to time the scope and features of the UAF WhatsApp Services to be made available and the Company may cancel, withdraw, suspend, vary, expand, or reduce the UAF WhatsApp Services at any time without giving notice or reason.
3.4 The Company has the right to offer additional services to you or modify existing services in respect of the use of the UAF WhatsApp Services from time to time, which may be subject to additional terms and conditions.
3.5 Virtual Assistant
3.5.1 The Virtual Assistant utilizes big data analytics, generative artificial intelligence and machine learning to address your general inquiries using WhatsApp Messenger as the communication platform. The accuracy, relevance, adequacy, reliability and quality of the responses of the Virtual Assistant may vary while such technology is constantly evolving.
3.5.2 The Virtual Assistant can provide answers to your queries about the products and services offered by the Company. You can interact with the Virtual Assistant to gain access to relevant information.
3.5.3 You acknowledged that the types and scope of services that the Virtual Assistant can perform for you are limited and the Virtual Assistant will not provide you with any advice, opinion, solicitation or recommendation.
3.5.4 The Company may analyse the conversations between you and the Virtual Assistant, including processing of big data analytics and using artificial intelligence and machine learning technology to improve the accuracy and performance of the Virtual Assistant, for the purpose of improving service quality of the Virtual Assistant.
3.5.5 Any information provided by the Virtual Assistant is intended for reference purposes only. It does not constitute an offer for any services and/or products of the Company, nor is it intended to provide professional advice.
3.6 All promotions and information relating to any products and/or services of the Company communicated to you via the UAF WhatsApp Account are subject to the respective terms and conditions of such promotions, products and/or services, which may be subject to change from time to time without notice.

4. Licensed rights

4.1 In consideration of your agreement to abide by these Terms and Conditions, the Company grants you a non-transferable, non-exclusive and revocable licence to use the UAF WhatsApp Services for the purposes set out under these Terms and Conditions only.

5. Ownership

5.1 You acknowledge and agree that all rights, title, interest and IP Rights subsisting in the UAF WhatsApp Services and Service Contents are owned exclusively by the Company or its third party licensors. You have no rights, title or interest in the UAF WhatsApp Services or any of the Service Contents. You shall not use any trademark, service mark, trade name or logo of the Company or any other IP Rights of the Company for any purpose without express consent from the Company. Nothing in these Terms and Conditions shall be construed as granting you any rights to such trademarks, service marks, trade names, logos or IP Rights. The Company reserves all rights not expressly granted under these Terms and Conditions.

6. Use of the UAF WhatsApp Services

6.1 To use the UAF WhatsApp Services, you shall maintain a valid account with WhatsApp. Your usage of WhatsApp will be governed by separate direct agreements you have in place with the operator of WhatsApp. It is your responsibility to check regularly for and accept any updates to terms and conditions, policies, service statements, business rules, announcement guidelines and/or any other provision governing your use of WhatsApp before using the UAF WhatsApp Services. The Company is not obliged to notify you of the applicable terms and policies prescribed by WhatsApp from time to time. The Company does not assume any liability or responsibility for the performance, quality, availability, security or any other issue of WhatsApp or any act or omission of the operator of WhatsApp. Without limiting the generality of the foregoing, the Company does not warrant or represent that there will be no interruption or delay in browsing the UAF WhatsApp Services or that there will be no leakage of any personal information, failure of transaction or information error caused by WhatsApp.
6.2 When using the UAF WhatsApp Services, you agree that you shall: –
6.2.1 be solely responsible for ensuring adequate protection and taking reasonable and appropriate precautions against any computer viruses, Trojan horses, worms, software bombs or other malicious software to any electronic equipment from which you access the UAF WhatsApp Services;
6.2.2 ensure you have the necessary capacity and authority before uploading, submitting, posting or transmitting Your Contents to the Company via the UAF WhatsApp Account. By uploading, submitting, posting or transmitting Your Contents to the Company via the UAF WhatsApp Account, you agree to grant the Company the right (but in no way an obligation) to remove, pre-screen, review, flag, filter, modify or refuse any of Your Contents at the Company’s sole discretion;
6.2.3 be solely responsible for, and the Company has no responsibility to you or to any other person for, your actions, omissions or any breach of your obligations under these Terms and Conditions;
6.2.4 use the UAF WhatsApp Services only for purposes that are expressly permitted by these Terms and Conditions;
6.2.5 not disassemble, decompile or reverse engineer any portion of the UAF WhatsApp Services;
6.2.6 not engage in any activity that interferes with or disrupts the UAF WhatsApp Services or the servers and networks through which the UAF WhatsApp Services are provided;
6.2.7 not copy, modify, adapt, reproduce, sublicense, download, exploit, re-publish, sell, distribute, translate, create derivative works from the UAF WhatsApp Services or Service Contents (in whole or in part);
6.2.8 not install, upload or transmit (or allow the installation, uploading or transmission of) any viruses or instructions, codes, techniques or devices or similar software, data or other harmful components capable of disrupting, disabling, damaging, destroying, shutting down, monitoring, overburdening or limiting the functionality of the UAF WhatsApp Services or other telecommunications or computer systems (including any hardware or software) or devices, or any data transmitted through or stored on them;
6.2.9 not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine” or in any way reproduce, disrupt or circumvent the structure or presentation of the UAF WhatsApp Services or Service Contents;
6.2.10 not hack, break into, or attempt to hack or break into, in any manner, the UAF WhatsApp Services or Service Contents and/or any data or information on the Company’s server(s) or that of any third parties;
6.2.11 not take any action or allow any other person to take any action that would enable you, or any other person, to gain unauthorized access to, monitor or tamper with or use any computer systems or networks of the Company or through which the UAF WhatsApp Services are provided;
6.2.12 not use the UAF WhatsApp Services or Service Contents in any way that is unlawful or breaches any applicable laws, or promotes illegal activities; and not violate any applicable laws relating to your use of the UAF WhatsApp Services or Service Contents;
6.2.13 not contravene or infringe the rights of any other person;
6.2.14 not use the UAF WhatsApp Services or Service Contents in any way to send, communicate or upload any materials or contents not belonging to you, or engage in any behavior or activities that are harassing, disruptive, offensive, abusive, threatening, indecent, defamatory, obscene, vulgar, pornographic, menacing, illegal, illicit or in contempt of any legal or other proceedings, or to send unsolicited communications, promotions, advertisements or spam messages; and
6.2.15 not use the UAF WhatsApp Services or Service Contents to impersonate another person or otherwise misrepresent or falsely claim an affiliation or relationship with another person or entity in a manner that does or is intended to mislead, confuse, or deceive others.
6.3 You understand and agree that you use the UAF WhatsApp Services and access the Service Contents at your own risk. You must evaluate, and bear all risks associated with the provisions of the UAF WhatsApp Services and Service Contents, including the accuracy, completeness, usefulness, fitness and suitability of any such content and information for any particular purpose.
6.4 You agree to avoid sharing confidential information (for example, personal data) with the Company through any third-party communication channels unless the Company has confirmed that such channel is secure enough to do so.
6.5 You agree that, if you receive a message from the Company via the UAF WhatsApp Account by mistake, you will not copy, forward, disclose or use any part of the content therein; and will delete the message and all copies of it and notify the Company immediately by replying thereto.
6.6 You acknowledge that other third-party channels, platforms or functionality integrations may be involved in the course of your use of the UAF WhatsApp Services. Your usage of such third-party channels, platforms or functionalities will be governed by separate direct agreements you have in place with them. It is your responsibility to check regularly for and accept any updates to terms and conditions, policies, service statements, business rules, announcement guidelines and/or any other provision governing your use of such third-party channels, platforms or functionalities. The Company is not obliged to notify you of the applicable terms and policies prescribed by such third-party channels, platforms or functionalities from time to time. The Company does not assume any liability or responsibility for the performance, quality, availability, security or any other issue of such third-party channels, platforms or functionalities or any act or omission of their operators. Without limiting the generality of the foregoing, the Company does not warrant or represent that there will be no interruption or delay in browsing any contents via such third-party channels or platforms or in using such third-party functionalities or that there will be no leakage of any personal information, failure of transaction or information error caused by such third-party channels, platforms or functionalities.
6.7 You agree to indemnify, hold harmless and defend the Company and its related companies, affiliates, officers, employees, agents, contractors and other partners against any and all claims, actions, proceedings, damages, injuries, liabilities and all costs suffered or incurred as a result of your use of the UAF WhatsApp Services and other related services, including but not limited to any acts or omissions by you that results in a breach of any or all of these Terms and Conditions.
6.8 If there is any dispute regarding the interpretation of these Terms and Conditions or otherwise in connection with your use of the UAF WhatsApp Services, the Company’s decision in relation thereto shall be final and conclusive.

7. Collection and use of data

7.1 The Company will retrieve your phone number via the UAF WhatsApp Account when you use the UAF WhatsApp Services.
7.2 The Company may collect the following data which may contain your personal data from time to time in relation to the Company’s provision and your use of the UAF WhatsApp Services:
7.2.1 communications between you and the Company in the course of your use of the UAF WhatsApp Services; and
7.2.2 any other data regarding your visits to and use of the UAF WhatsApp Services.
7.3 Any conversations between you and the Company and other information provided to the Company in the course of your use of the UAF WhatsApp Services will be collected, used, stored and disclosed for providing, maintaining, managing and operating the UAF WhatsApp Services, including processing by big data analytics and artificial intelligence and machine learning technology to improve its accuracy and performance.
7.4 Any conversations between you and the Company and other information provided to the Company in the course of your use of the UAF WhatsApp Services are transmitted to and stored by the Company and authorised third parties, which may include processing overseas.
7.5 Any conversations between you and the Company and your personal information provided to the Company in the course of your use of the UAF WhatsApp Services is subject to the terms and conditions set out in the “Notice to Customers and other individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” of the Company. By using the UAF WhatsApp Services, you (a) agree and acknowledge that you have read, understood and agreed to the “Notice to Customers and other individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” of the Company, and (b) consent and acknowledge that the Company is permitted (but are not obliged) to use your mobile phone number registered with WhatsApp and any other information to contact you at any time to follow up with and/or handle your inquiries in relation to any products, services, application and/or other matters made to the Company (if any).
7.6 The contents of any conversations between you and the Company in the course of your use of the UAF WhatsApp Services will be stored, processed and retained by the Company in the manner as prescribed by the “Privacy Policy” of the Company.
7.7 When using WhatsApp, you are bound by the WhatsApp Terms of Service and Privacy Policy and any other terms and conditions prescribed by WhatsApp from time to time. It is your responsibility to review and accept the terms and conditions of WhatsApp before using the UAF WhatsApp Services. The Company is not obliged to notify you the applicable terms and policies prescribed by WhatsApp from time to time. You are required to ascertain and observe those terms and policies. The Company is not responsible for any act or omission of WhatsApp, including how WhatsApp may collect, use, transfer or handle your personal information or your content.
7.8 Without prejudice to the “Notice to Customers and other individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” of the Company, you agree that the Company may use all accessible information and data collected whether or not in the course of your use of the UAF WhatsApp Services for the following purposes:
7.8.1 to provide the UAF WhatsApp Services;
7.8.2 to provide you with a more personalised experience in respect of your use of the UAF WhatsApp Services;
7.8.3 to improve the products and/or services of the Company and design and develop loan/credit facilities or other financial products or services of the Company;
7.8.4 to train, improve, administer, enhance and maintain the UAF WhatsApp Services and related data analytics;
7.8.5 to better understand how you use the UAF WhatsApp Services;
7.8.6 to respond to any service issues you may have in using the UAF WhatsApp Services;
7.8.7 to resolve any disputes which may arise between the Company and you, or enforce the Company’s rights against you in any legal proceedings, or to defend the Company against any claim, in relation to you;
7.8.8 to comply with applicable laws or regulations or any guidelines, guidance or requests given or issued by any regulatory authority and any international guidance, internal policies or procedures, existing currently or in the future; and
7.8.9 other purposes stated in the “Notice to Customers and other individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” of the Company, which can be accessed via the following hyperlink: https://www.uaf.com.hk/en/privacy-policy/
7.9 You are at all times responsible for the security and confidentiality of your electronic devices, logon credentials (including without limitation user name, biometric data, account number and password) and any other personal data in the course of your use of the UAF WhatsApp Services.

8. Third Party Materials

8.1 The UAF WhatsApp Services and Service Contents may contain Third Party Materials. You acknowledge and agree that the Company has no responsibility or liability in relation to the Third Party Materials, and has no obligation to actively monitor or exercise any control over them.
8.2 The Company does not endorse, verify or make any warranties or representations in relation to any Third Party Materials, and disclaims all responsibility and liability for the quality, completeness, accuracy, usefulness, timeliness, reliability or continuity of any content in such Third Party Materials. You use and rely on the Third Party Materials at your own risk.
8.3 If Third Party Materials contain links to other websites and resources provided by or originated from third parties, these links are provided for your information and reference only. You understand that the Company may have no control over such websites and resources, and the Company will not bear liability for any loss and damage caused to you arising from the presence, use, suspension, disruption and/ or other non-availability of these websites and resources. Your interaction with these websites and materials will be at your own risk and responsibility. The inclusion of a link to another website made available to you in the course of your use of the UAF WhatsApp Services does not imply any endorsement of, or association with, the websites or resources themselves or of those in control of them. The Company is not responsible for the content of any external websites or resources.

9. Authentication

9.1 You acknowledge and agree that the Company may require you to verify your identity when you access any or all of the UAF WhatsApp Services via one-time password authentication and/or two-factors authentication procedure(s) as prescribed by the Company from time to time. Your use of such authentication procedures(s) is subject to the relevant terms and conditions effective from time to time between you and the Company, which can be accessed via the following hyperlink. For details, please refer to “Terms and Conditions for Authentication Procedures”.

10. Warranties and Disclaimers

10.1 The Service Contents and any other contents made available to you in the course of your use of the UAF WhatsApp Services are for your general reference only, and are not and should not be regarded as professional or other advice. You should seek independent professional advice where necessary. The Company is not responsible for informing you about any changes in laws, regulations, promotions and offers, market information and/or interpretations, and how they may affect you.
10.2 The UAF WhatsApp Services are primarily intended for those who access the same from or within Hong Kong. The products and/or services to which the UAF WhatsApp Services refer are offered only in jurisdictions where and when they may be lawfully offered by the Company. The UAF WhatsApp Services and the Service Contents are not intended for use by persons located in or resident in jurisdictions which restrict the distribution of any contents by the Company. You are solely responsible for observing and complying with all relevant restrictions.
10.3 You agree that your use of the UAF WhatsApp Services and Service Contents is at your own risk, and that the UAF WhatsApp Services and Service Contents are provided on “as is” and “as available” basis without representation or warranty of any kind either express or implied. The Company does not guarantee any information made available to you in the course of your use of the UAF WhatsApp Services will fully meet your needs or expectations, or provide you with full, complete or comprehensive answers or responses.
10.4 The Company has discretion as to whether to provide any information, products or services to which the UAF WhatsApp Services refer to any person. Any information, products or services described by the UAF WhatsApp Services may be withdrawn or amended at any time without advance notice at the sole discretion of the Company.
10.5 To the fullest extent permitted by applicable law, the Company expressly disclaims all conditions and warranties of any nature or kind, whether express or implied, in relation to your access to the UAF WhatsApp Services, Service Contents and Third Party Materials.
10.6 All information you provide in the course of your use of the UAF WhatsApp Services will be recorded, processed and stored by the Company and authorized third parties.
10.7 Without prejudice to the generality of Clause 8 above, the Company makes no representation or warranties:
10.7.1 as to the accuracy, quality, completeness, timeliness, adequacy, security, reliability or validity of the UAF WhatsApp Services, Service Contents or Third Party Materials; or
10.7.2 that your use of the UAF WhatsApp Services, Service Contents or Third Party Materials will be uninterrupted, timely, secure, free of any error or defects, or free of any viruses, instructions, codes, techniques or devices or similar software, data or other harmful components capable of disrupting, disabling, damaging, destroying, shutting down, monitoring, limiting the functionality or gaining unauthorized access to any telecommunications or computer systems (including any hardware or software) or devices, or any data transmitted through or stored on them.

11. Limitation of Liability

11.1 To the fullest extent permitted by applicable laws, the Company excludes all implied representations, conditions and warranties whether statutory or otherwise.
11.2 The Company shall not be liable to you or any other person in contract, tort (including negligence), breach of statutory duty or for any losses of any nature or type (whether general, special, indirect, direct, nominal, punitive, incidental or consequential) which you may incur or suffer arising from or in connection with any access or use of the UAF WhatsApp Services, Service Contents, Your Contents or Third Party Materials, whether or not the Company knows of the possibility of such losses.

12. Suspension or Termination

12.1 You can stop using the UAF WhatsApp Services at any time.
12.2 The Company has the right to suspend or terminate your access to and use of the UAF WhatsApp Services at any time with or without prior notice at its sole discretion. The Company also has the right to amend, delete or cease providing (in whole or in part) the UAF WhatsApp Services or Service Contents from time to time with or without prior notice at its sole discretion.
12.3 The Company has the right to terminate your license to use the UAF WhatsApp Services and the Service Contents immediately without giving you notice or reason if:
12.3.1 you have seriously or persistently breached any of these Terms and Conditions and/or any other relevant terms and conditions that are applicable to your use of the UAF WhatsApp Services; or
12.3.2 the Company knows or reasonably suspects that you have committed or are about to commit fraud or any other illegal or improper act; or
12.3.3 you are not eligible or entitled to use the UAF WhatsApp Services for any reason; or
12.3.4 the UAF WhatsApp Account or your WhatsApp account is withdrawn by WhatsApp for any reason; or
12.3.5 the WhatsApp Messenger is terminated; or
12.3.6 any other grounds as the Company may deem necessary at its sole discretion.

13. Severability

13.1 If any provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable, such illegality, invalidity or unenforceability does not affect any other provision which remains in full force, validity and effect.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, including the interpretation thereof and any disputes relating thereto, shall be governed by and construed in accordance with the laws of Hong Kong.
14.2 You agree to be subject to the non-exclusive jurisdiction of the courts of Hong Kong. You further agree that these Terms and Conditions may be enforced in the courts of any competent jurisdiction.

15. Assignment

15.1 You may not transfer any of your rights or obligations under these Terms and Conditions without the prior written consent of the Company.
15.2 The Company may assign, sub-participate, sub-contract or transfer any or all of it rights and obligations under these Terms and Conditions without your consent.

16. Waivers

16.1 A waiver by the Company of any of these Terms and Conditions will be effective only if given by the Company in writing and any such provision is waived only to the extent that is expressly stated in the relevant notice in writing. No failure, relaxation, forbearance, indulgence or delay by the Company in exercising any right, power or remedy will prejudice, affect or restrict any of the rights and powers the Company may have under these Terms and Conditions, or operate as a waiver of that right, power or remedy, nor will any single or partial exercise preclude any other or further exercise of a right, power or remedy. Any right, power or remedy under these Terms and Conditions is intended to be cumulative and in addition to any other right, power or remedy the Company may have in law.

17. Third Party Rights

17.1 The Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) shall not apply to these Terms and Conditions. Unless specifically provided herein, no person other than the parties to these Terms and Conditions and any assigns of the Company shall have any rights under it, nor shall these Terms and Conditions be enforceable by any person other than the parties herein.

18. Language

18.1 Where these Terms and Conditions are translated to other languages, if there are any inconsistencies between the English and the translated versions, the English version shall prevail.
